AI and Privacy Disclaimer

1. About this Disclaimer

This AI and Privacy Disclaimer (“Disclaimer”) explains how Small Venue Ticketing LLC, a Georgia limited liability company doing business as DRT Performance Tix and as DRT Performance Pix (“DRT”), and Algoritmo Software Inc., a corporation incorporated under the laws of Ontario, Canada doing business as Snappic (“Snappic,” and together with DRT, “we,” “us,” and “our”), handle personal information, including photographs of children, in connection with the DRT Performance Pix service (“DRT Pix” or the “Service”).

Snappic owns and operates the platform behind DRT Pix and stores and processes photographs and account information on the Service. DRT offers the Service to dance studios under the DRT Pix name.

This Disclaimer forms part of the DRT Pix Terms and Conditions and should be read together with them.

Your dance studio is an independent reseller of the Service. The studio runs photo day, decides which participants are photographed, and is responsible for obtaining consent from families before any photographs are taken. The studio also keeps its own records about you and your child, and the studio’s handling of that information is governed by the studio’s own privacy practices and not by this Disclaimer. This Disclaimer covers only how the Service itself handles information.

2. Because this Service involves children

DRT Pix is used to photograph children at dance studios. We do not knowingly provide the Service to children directly. We rely on you, the parent or legal guardian, to make decisions and give consent on your child’s behalf. Consent for AI enhancement is handled through your dance studio (see §4), and we treat children’s photographs as sensitive information.

3. Information we collect

  • Children’s photographs taken at photo day, and any AI-enhanced versions you opt in to.
  • Account and contact information (such as parent/guardian name, email, and the studio and class your child belongs to).
  • Purchase information (products bought, delivery address; payments are handled by our payment processor and we do not store full card numbers).
  • Consent records (what you consented to, and when, including AI-enhancement and marketing choices).
  • Technical information needed to operate the gallery securely (such as access logs).

4. How AI enhancement works

Where you have consented through your studio (see the Terms & Conditions §4), we apply automated (AI) enhancement to your child’s photographs to (a) change or replace the background, which may composite your child into a different or artificially generated scene (so the image may show your child in a setting where the photo was not actually taken), and (b) apply touch-ups to your child’s image (color, lighting, skin, and minor blemish correction). You may opt out through your studio at any time. We may identify AI-enhanced images as digitally or AI-altered.

  • We do not use facial recognition and do not try to identify anyone from their face.
  • Third-party AI providers. Editing is performed using Google’s Gemini and Topaz (Topaz Labs). To do the editing, your child’s photographs are transmitted to and processed by these providers as our service providers.
  • No training on your child’s images. We require that these providers do not use your child’s photographs to train their AI models and process them only to provide the editing to us.

5. How we use information

  • to run private photo galleries and let you view your child’s photographs;
  • to fulfill the digital and physical products you purchase;
  • to apply AI enhancements where you have consented through your studio;
  • to keep records of your consents and choices;
  • to secure the Service and prevent misuse; and
  • to send you photographs of your child for marketing only where you have given separate, opt-in marketing consent.

We do not sell your or your child’s personal information, and we do not “share” it for cross-context behavioral advertising as those terms are used under California law.

6. Who we share information with

We share personal information only as needed to run the Service:

  • Snappic, which owns and operates Picfolio, which is whitelabeled as the DRT Pix platform and owns the copyright in the photographs for 90 days after the photos are taken;
  • AI providers (Gemini and Topaz) that perform opted-in enhancing;
  • hosting, storage, print-fulfillment, and payment providers; and
  • your dance studio, which runs photo day and manages participation and opt-outs.

We may also disclose information if required by law or to protect rights and safety. We do not otherwise sell or rent personal information.

7. Where information is stored, and transfers

Personal information may be stored and processed in the United States, Canada, or other countries where our providers operate (including where Gemini and Topaz process images). Where information crosses borders, we use encryption, when possible, to protect it.

8. How long we keep information

We keep photographs and related information only as long as needed to provide the Service and for the periods below, then delete or de-identify them:

  • gallery photographs: available for 12 months after photo day, then deleted;
  • purchased digital files: available to you for a 12-month period;
  • consent and transaction records: kept for 7 years to meet legal obligations.

You can ask us to delete your child’s photographs sooner (see §10).

9. How we protect information

We use commercially reasonable technical and organizational safeguards, such as access controls on galleries, encryption in transit, and limits on who can access children’s photographs. No system is perfectly secure, so we cannot guarantee absolute security, but we work to protect your child’s information and will notify you and regulators of a breach where the law requires.

10. Your rights and choices

Depending on where you live, you (on your child’s behalf) may have the right to:

  • access the photographs and information we hold about your child;
  • correct inaccurate information;
  • delete your child’s photographs and information;
  • withdraw consent to AI enhancements or marketing at any time;
  • opt out of any sale or sharing (note: we do not sell or share children’s information); and
  • ask how your information is processed, and not be discriminated against for exercising these rights.

To exercise any of these, contact us at info@drttix.com. We will verify that you are the parent or guardian before acting. We aim to respond within 2 business days. Withdrawing consent will not affect processing already carried out before withdrawal.

11. U.S. children’s privacy (COPPA)

Because DRT Pix involves photographs of children, we confirm or obtain verifiable parental consent before collecting or processing a child’s photographs for AI editing, we limit collection to what is needed for the Service, and we give parents the ability to review and delete their child’s information and to refuse further collection.

12. California privacy (CCPA/CPRA)

If your child is a California resident, they have the rights described in §10. We treat a child’s photographs as sensitive personal information, do not sell or share it except as noted in §6, and do not use it beyond providing the Service and the purposes described here. California residents may also designate an authorized agent to make requests.

13. Canadian privacy (PIPEDA and Quebec Law 25)

For families in Canada, we collect, use, and disclose personal information with your knowledge and consent and only for the purposes described here, and we treat children’s information as sensitive. If you are in Quebec, additional rights under Law 25 apply, including specific transparency and consent requirements and rights regarding automated processing.

14. Changes to this Disclaimer

We may update this Disclaimer from time to time. If we make material changes to how we handle your child’s information, we will give notice and, where the law requires, seek fresh consent. The effective date at the top shows when this version took effect.
